After a slip and fall, is it a good idea to talk to insurance companies?
Answer:
It’s never a good idea to talk to the insurance company for the establishment where you fell after you have a slip and fall injury in Florida. Why? Because the insurance company is going to want to get a statement. You have not consulted with an attorney yet, so you don’t know about things you maybe should not say that could end up hurting the value of your case later on. We’ve had folks come to us where they have a slip and fall and have talked to the insurance company and given a statement. We then take the case on and find out later on in the case that they’ve given this statement, and some of the things they’ve said have hurt the value of the case.

We can either make sure that you understand the questions that are going to be asked before you give the statement or, more likely than not, we’ll just tell you we’re not going to give a statement and will just submit your theory of how the accident happened by way of a demand letter to the insurance company, and that protects you from saying anything you should not say.
