How does a warning sign affect a slip and fall claim in Southwest Florida?

We had a gentleman come to us with a slip and fall in Florida, and he said, “Well, there was a ‘Slippery When Wet’ floor sign that was somewhat near me.” We told him, “You can still recover.” In Florida there is the legal principle of comparative fault. In this particular case there was an employee mopping the floor during the middle of the day and didn’t have wet floor signs. There was one that was put in an aisle near where the person fell, and the defense argued, “Well, you can’t recover because there was a ‘Wet Floor’ sign,” and that’s not the truth. The defendant was negligent in that scenario. The plaintiff can also be found partially at fault.
If you hire an experienced attorney, they can make the appropriate arguments to show that your fault was much less than the property owner’s fault, that the property owner violated their own policies and procedures by mopping in the middle of the day; that was how this particular case went. You still have a case. You should reach out to an attorney. Sometimes attorneys that know that there’s a wet floor sign will actually turn the case back to the client and say, “You don’t have a case,” but always seek a second opinion in that regards.
