In Florida, there are really two statute of limitations for insurance claims as a result of a hurricane. The first is the five-year statute of limitations which means you have five years to file a lawsuit fi that becomes necessary or settle the case. However, if a claim has been presented and denied early on and the insurance company has told you that they’ve closed your file or their file, then you must ask them to reopen a claim within three years from the date of the hurricane, otherwise your claim will be barred.
