Brandon was headed downtown to meet some friends for dinner. He was looking forward to seeing a couple of guys from out of town. On the way there, he was thinking about how he should get something cheaper on the menu. He was saving up for a down payment on a house. He and his fiancée were getting married in the fall of that year. He decided that he would put $10 away for the house today.
Brandon noticed someone on the side of the road holding a sign. There was a store opening.
As he turned his eye back to the road to come to a stop, he was abruptly taken out of his thoughts when he heard a terrible crunching sound.
Thrown forward in his seat, he realized someone had just rear ended his car!
He ended up colliding with the car in front of him.
After the jitters of the initial shock faded, he assessed himself. He felt fine. There did not seem to be a scratch on him.
Then the worry for his car set in. He realized his car had shut off. He tried to start it a few times but it did not budge.
He hopped out of this car to take a look. His stomach dropped. There was a lot of damage. He was no mechanic but he knew it would be quite the bill to get this thing running again.
He had just bought this car two years before the accident. He was not even finished paying it off. He couldn’t imagine the cost of this repair.
Brandon began to feel immediately helpless about the situation. There was no way he was putting any money away for a house now.
Turns out the driver behind him was so distracted by the sign on the side of the road he caused the pile up. The driver was very sorry but the damage was done.

Trusting the Insurance Company
You may have the idea that the insurance companies are looking out for you. They do a great job with their marketing and commercials. They make people believe that are here to help us when things go wrong. This is not true. While they certainly provide you with coverage sometimes, they can be notoriously challenging to work with.
When you are going up against a liable party’s insurance company, you are going to be faced with the challenge of getting them to cooperate. Their cooperation would mean that they have to cough up money. They don’t want to do that. They want to save themselves money.

You should not allow them to gain any leverage.
They want to blame you for the accident. If they get a recorded statement from you, they can accomplish that.
There is nothing in the law that says you need to talk to them about the accident.
If they can get you to say something that makes it seem like you were at fault for the accident, then you could miss out on compensation. If, for example, Brandon had agreed to give the insurance company a recorded statement, they could have gotten him to say something that made it seem like he was the one distracted by the sign, not the other driver. That would have certainly ruined his case.
