A medical expert is the key to a medical malpractice case. He or she has to be a similar healthcare provider, as that term is defined in the Florida statutes, meaning that if the target defendant is an orthopedic surgeon, the plaintiff’s medical expert has to be an orthopedic surgeon.
That individual locates all pertinent medical records, reviews the medical records, and forms an opinion as to whether the defendant breached the accepted standard of care. If the answer is yes, there’s a valid claim. If the answer is no, there’s not a valid claim, but a medical expert is critical to any medical malpractice case.
