Does all property have to go through probate when a person dies?

Not all property has to go through probate when a person dies. Assets that are jointly held with naming a survivor do not have to go through probate. Assets, such as life insurance, or a 401(k) where a beneficiary is named do not have to go through probate. As well as assets that pass through a living trust where the trustee can make distribution do not have to go through probate.
